BGP represents clients as plaintiffs or defendants in litigation, arbitration or mediation arising out of construction projects, including all phases of litigation, from pleadings and discovery through trial.  Our attorneys employ alternative dispute resolution as a method of case resolution that reflects the ever-increasing expense of litigation in the court system. At the beginning of the discovery process, we seek to identify those matters most amenable to early resolution in lieu of protracted litigation that is not in the best interests of our clients. On numerous occasions our attorneys have been successful in resolving what would otherwise have been costly disputes, by participating in mediation or arbitration.

We also advise clients on protecting their rights and remedies in the construction industry, such as providing information on Notices of Claim, Notices of Default, Responses to Claims, and statutory deadlines relating to issues under construction contracts and applicable New York Law.

We draft contracts on behalf of all participants, from developers and general contractors to subcontractors and suppliers, including . extensive negotiations on behalf of our clients with owners, general contractors, subcontractors, and all other parties in a construction project.

We provide clients with the information necessary to file Mechanics Liens, respond to Mechanics Liens, and advise them of the statutory requirements for the handling of construction funds as trust funds under the New York Lien Law.
